Unfair
I have been appointed by my 3 siblings as executor of our late mums estate because none of them is in a position or chooses to have anything to do with the property I have been asked by the 3 to move in the property and cancelling my lease at my previous residence. I have been living in the property for 7yrs with my family maintaining the up keep paying rates as well.as all the transfer fees and because of me the value of the property as increased without their assistance in anyway for 7yrs and present they are demanding full equal share of the property.Kindly advise.Thank you

Dispute over the property: Erf 424
Hi everyone it's really a privilege for me to be here. I have a scenario, where our mom passed again in 2001. Our eldest sister was our executor and she basically did nothing until 2022. We were five kids but now we are only three. Two brothers passed way. My mom left behind a testament, whereby she indicated in the testament. I have been living in the property for more then 45 yrs. I have been maintaining the property and keep on paying rates and taxes for more then 21 years with my two brothers (families) visiting. I am the last born my eldest sister is in her house that she got from mom (voetstoot). My brother was in prison for more than 18 years. I have been in the house since my mom passed away taking care of the house. I got married two years ago. Now my siblings chased me out from the house. I have been staying around here and there until I moved out of town. I reported the matter to our Authority (Master of High Court). Currently, the matter is with the law firm I was referred to. The Master of High Court give the Law Firm the Authority to administrate the testament. But the whole process its so dragging and it seems that the Law Firm only wants straight forward cases. My bother is violent and he doesn't know how to sit down like an adult to resolve an issue. All he knows is to fight, frightening and he can quickly lost his temper. I have wrote several letters to the Law Firm. Still waiting and I serious don't know how to handle the matter now. Donation or Inheritance?
A mother wants to give her house to her eldest son. She has two other children one who has verbally indicated he wants nothing to do with the property or the mother and another who the eldest entrusted his house to and placed the title deed of his own house on her name and she refuses to give it back to him. Is it more cost-effective for her to: 1) donate the house to him 2) sell the house to him 3) leave it in her will for him To secure her there would need to be a usufruct that she has exclusive use of the property until her passing if it is not left in her will for him. She is a pensioner, does she pay Capital Gains Tax if the property is valued at between R500 000 and R700 000. Does she pay transfer duty? If it is a donation what are all the costs to consider? We are trying to figure out the best route to take.
