SMS compliance - Europe

Hi guys! I am new to DBR and I have a question: Most of the prospects I’ve been looking at, they do NOT write on their website form that they’ll be sending out SMS. - Is that not a problem? What help is it if they have a list of 10.000+ people, if those people never ticked a box saying “I agree to receive offers on e-mail and SMS”??? I do not know about US, but here in Europe I am pretty sure that is the law. At least to my understanding after reading about “SMS compliance”. Any thoughts,
