Tenant deposits
This has been a debate and a topic for many property managers. For a long time I would send the money to the landlord, but what happens when landlord is irresponsible, they use the funds, or worse they get foreclosed. This was a pivotal point for us, though legally we are not responsible, we get our name dragged through the mud. We also have an option to hold funds in trust to protect landlord from themselves, after the foreclosure debacle we decided the only we we would manage the property was if we hold the deposits. We do the move out and deposit refund letters so it just made sense for our company. . Do you hold the deposit or does your landlord hold the deposit?

Nerd Confession 2
So, we are a week or so into this thing and I'll be honest I thought we would have a lot more members. 🤔 But with anything that is worth while and great, it takes time. 🕰️ This day in age it seems that people are overnight successes and that's just not the case. They put in hours and hours of work and we just see final product. We have to stay persistent and diligent in our pursuits and over time, through the journey, we will build something great. 🏗️ So, thank you to all the current Nerds in the group and thank you for the feedback as we build and make things better for all PM Nerds out there! Nerd 1 out! 🤓👋

Sometimes you have to plant the seed in order for it to grow. Don’t worry it takes time but it will grow on its own pace. Giving back and helping our PM nerds is the key 🙃

This happens a lot more than you think because of the fraudulent documentation the applicant presents to home owners. I think it’s important to have a right screening system including but not limitless to selfies, paystubs, bank statements, rental verification, employment verification. As a PM I have found fake paystubs where the YTD information didn’t add up, making 15 an hour and YTD is 35,000, and it’s only February, that’s when you know they altered the docs. Or you approve a person that has great credit, employment and rental to find out they stole someone’s identity, this happened a lot during Covid because we weren’t meeting with people. We have upgraded our process to detour these situation, from happening.

Guys, I had a tenant, she slipped and fell and sued us and owner. On top of that she claimed she had a baby and lost it.. and she had just had a baby that was 2-3 months old, well I found out owner didn’t have insurance, but guess who did. Well, her attorney sent both owner and I a max claim of 1 million, so I told our attorney we need to fight this. She is one of those persons that hates everybody, talks down, cursed at landscaper, talked down to the AC person, I mean I had to get testimony from each vendor to show her character. So, this had been going on since June 2022 as a property manager this was stressful, how can someone get 1 million from us when they lied. In the testimony she lied about notifying us the stairs were faulty and we were negligent as a pm, that never happened. She even said she had proof, well we needed to go to court to see this proof because 🤯, we’ll all that to say a few weeks ago we received a letter saying the tenant was withdrawing her claim, man that was a relief. Have you ever been sued or have a similar story?

@Danielle Bilumbu Hey Danielle sorry to hear that, so a few things happen..(PS I’m not an attorney but I will recommend legalshield for small businesses, I pay$39 a month you get one free consultation, they review the information and if it really goes into lawsuit they referral an attorney in your area for 25% off for being a member of legalshield) 1)if it’s a tenant demand letter saying they will sue, have the above respond saying it was a lease transaction the owner did not disclosed any information indicating the house was being foreclosed and maybe attorney can recommend putting owners information so she can try to get her issue resolved. 2) they have tried to communicated with you and they haven’t gotten a resolve and it goes to actual lawsuit this is most likely done on Jp court level you can go and represent yourself and take lease listing or management agreement to show what our actual duty was which was lease the house, can also take an attorney to Jp court, these court give residence the right to sue for up to $10,000, (might have gone up but not relevant) 3) if you in fact made an error our EO insurance covers our mistakes, which I don’t think you are at fault but what I have learned is get your insurance involved to cover your bases and if you did make a mistake they will cover you under your policy. They provide an attorney they determine you didn’t make a mistake and defend you that’s why we pay insurance monthly. In my scenario I didn’t make a mistake it wasn’t my personal rental and I went through my actual insurance because 1,000,000 was a lot to dispute.
